These Terms & Conditions (“Terms”) govern access to and use of Faltive’s website, services, subscriptions, packages, add-ons, and related communication channels.
By using Faltive’s website, purchasing a service, signing an order form, completing checkout, or asking Faltive to begin work, you agree to these Terms. If you are accepting these Terms on behalf of a company or organization, you confirm that you have authority to bind that organization.
1. About Faltive
Faltive provides ongoing design and development capacity for growing teams. Services may include product design, website design, brand design, frontend development, supported full-stack development, implementation, QA, technical handoff, and related project support.
Faltive works through a shared request queue and active workstreams. A paid Faltive Slot provides one active workstream at a time. Additional slots may be purchased when multiple workstreams need to move in parallel.
2. Services and Workstreams
Each request must be confirmed before work begins. Faltive may confirm the scope, required inputs, dependencies, delivery condition, estimated delivery window, acceptance criteria, and known exclusions.
Delivery estimates are planning targets, not guaranteed deadlines, unless a signed order form expressly states otherwise.
3. Queue and Capacity
You may add multiple requests to the shared queue. Faltive will work on the highest-priority confirmed request according to the number of active paid slots.
Slots provide delivery capacity, not guaranteed labor hours, named personnel, or a fixed number of pages, screens, features, or revisions.
4. Customer Responsibilities
You agree to provide complete and legally usable content, assets, brand materials, access, credentials, licenses, technical context, feedback, and approvals required for Faltive to perform the services.
You are responsible for reviewing all deliverables before publication, launch, or use.
5. Revisions and Scope Changes
Revisions are included when they remain within the confirmed brief and use the active slot like any other work. A request may be re-scoped if it introduces material new requirements.
6. Subscriptions, Packages, and Add-ons
Faltive may offer monthly subscriptions, annual plans, Trial engagements, New Customer Pay As You Go engagements, Test Flight engagements, Brand Sprints, Partner add-ons, Priority Lane add-ons, and Care add-ons.
Priority Lane changes scheduling priority for an existing paid slot. It does not create an additional slot, team, or parallel workstream.
Care provides limited ongoing support for supported production applications or websites and is not 24/7 support or an uptime guarantee.
7. Billing and Payment
Unless otherwise stated in writing, subscriptions and add-ons are billed in advance and renew automatically according to the selected billing cycle. Card payments may be processed by Stripe or another approved payment provider.
8. Failed Payments and Suspension
If payment fails or becomes overdue, Faltive may retry payment, pause new work, withhold release or handoff, suspend services, or terminate the engagement after reasonable notice.
9. Cancellation and Pauses
Monthly subscriptions may be cancelled through the written cancellation channel stated by Faltive before the next renewal cutoff. Cancellation stops future renewals but does not refund charges already incurred.
10. Refunds and Credits
Service fees are non-refundable once the applicable paid period or engagement has begun, except where required by law or expressly approved by Faltive in writing.
11. Third-Party Costs and Services
Third-party platforms, hosting, domains, fonts, software, plugins, APIs, and other external services are not included unless stated in writing.
12. Ownership and Handoff
After full payment, you own the final custom deliverables created specifically for your approved engagement, subject to these Terms and third-party license restrictions. Faltive retains ownership of its pre-existing tools, templates, methods, and reusable components.
13. Portfolio Rights
Unless otherwise agreed in writing, Faltive may display completed work in its portfolio and marketing materials.
14. Confidentiality
Each party agrees to protect the other party’s confidential information using reasonable care and to use it only for the engagement.
15. AI-Assisted Tools
Faltive may use AI-assisted tools for drafting, design exploration, code generation, documentation, testing, QA, and internal productivity, with reasonable care.
16. Security and Sensitive Data
Faltive applies reasonable technical and organizational safeguards. You must not send raw passwords, full payment-card data, or other highly sensitive data through ordinary email, chat, tickets, or design files.
17. Acceptable Use
You may not use Faltive’s services for unlawful, infringing, deceptive, malicious, or abusive purposes. Faltive may refuse, pause, or terminate work that creates legal, security, or safety risk.
18. Limited Warranty
Faltive will perform services in a professional manner and may correct reproducible defects reported within 10 business days after initial production release if the delivered work does not materially match the confirmed brief.
19. Disclaimers
Except as expressly stated in a signed agreement, Faltive’s website, services, and deliverables are provided on an “as is” and “as available” basis.
20. Limitation of Liability
To the maximum extent permitted by law, Faltive will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Faltive’s total liability for any claim will not exceed the amount paid by the customer to Faltive for the service giving rise to the claim during the three months before the claim arose, unless a signed agreement states otherwise.
21. Indemnification
You agree to defend, indemnify, and hold harmless Faltive from claims arising from your materials, instructions, misuse of deliverables, or breach of these Terms.
22. Termination
Faltive may suspend or terminate services for overdue payment, security risk, unlawful instructions, material breach, or abusive conduct.
23. Changes to These Terms
Faltive may update these Terms from time to time. Continued use after updates become effective means you accept the updated Terms.
24. Governing Law
These Terms are governed by the laws of Indonesia. Any dispute will be handled in the courts of Jakarta, unless a signed agreement states otherwise.
